1. JURISDICTION AND CONSUMER LAW

1.1 This warranty is governed by the laws of the country in which the Product was originally supplied by Enable Lifecare Pty Ltd or its authorised distributor.

1.2 For Products supplied within Australia, this warranty is governed by Australian law and includes all protections under the Australian Consumer Law (ACL).

1.3 For Products supplied outside Australia, local consumer protection and product warranty laws may provide additional or different rights to those set out in this document. Where such local laws apply, this warranty operates in addition to, and does not exclude, limit or modify any rights that cannot lawfully be excluded under the applicable national or regional law.

1.4 Enable Lifecare warrants compliance with all applicable medical device regulations and consumer protection laws in each country or region where the Product is legally supplied or distributed, to the extent required by those laws.

1.5 In the event of a conflict between this warranty and mandatory local law, the provisions of that local law shall prevail only to the extent of the inconsistency.

1.6 Nothing in this warranty limits or excludes Enable Lifecare’s obligations or responsibilities relating to the safety, quality, performance, or regulatory compliance of the Product, as required by the applicable laws, regulations, or recognised standards in any jurisdiction where the Product is placed on the market or used.

1.7 This warranty is in addition to, and does not exclude, restrict, or modify, any statutory rights and remedies to which the purchaser is entitled under the Australian Consumer Law (ACL).

1.8 Under the ACL:

  • Consumers are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage; and
  • Consumers are entitled to have goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

2. DEFINITIONS

2.1 Product means the Enable Lifecare pressure care system purchased by the customer and includes one or more of the following components:

    a) Pump/Control Unit (the powered air pump or control module); and
    b) Mattress (the air mattress component, including its air cells and internal air management components).

2.2 Standard Warranty Period means twelve (12) months from the date of purchase, unless otherwise stated in Clause 3.

2.3 Authorised Service Provider means a service provider approved in writing by Enable Lifecare to service the Product.

2.4 Service-life components means components that are expected to require replacement as part of normal servicing, as outlined in the manufacturer’s maintenance guidelines.

2.5 Warranty against defects means this voluntary warranty provided by Enable Lifecare in addition to rights under the ACL.


3. WARRANTY PERIODS

3.1 Pump/Control Unit Warranty

a) The Standard Warranty Period for the Pump/Control Unit is twelve (12) months from the date of purchase.
b) An Extended Warranty Period of up to nine (9) additional years (ten (10) years total) will apply only if the conditions in Clause 4 are met.
c) If the conditions in Clause 4 are not met, coverage under the Extended Warranty will not apply and the Pump/Control Unit warranty under this voluntary warranty is limited to the Standard Warranty Period.
d) For clarity, failure to meet extended warranty conditions does not affect any rights or remedies available under the ACL.

3.2 Mattress Warranty (5 Years)

a) The Mattress is covered by a warranty period of five (5) years from the date of purchase.
b) The Mattress warranty applies subject to the exclusions in Clause 6 and the claim process in Clause 9.
c) The Mattress warranty does not extend beyond five (5) years, even if pump extended warranty conditions are satisfied.

Important: The Pump/Control Unit and Mattress are warrantied under different warranty periods, and one does not automatically extend the other.


4. CONDITIONS FOR PUMP/CONTROL UNIT EXTENDED WARRANTY (UP TO 10 YEARS)

The Pump/Control Unit Extended Warranty will only apply if:

a) The Product is registered with Enable Lifecare within ninety (90) days of the purchase date.
b) The Pump/Control Unit is serviced at least once every twelve (12) months by an Authorised Service Provider.
c) Components designated as service-life components are replaced at the intervals specified in the manufacturer’s maintenance guidelines, including without limitation:

  • Batteries;
  • Compressors;
  • Solenoids;
  • Seals, gaskets, and other parts specified by Enable Lifecare.

d) The purchaser retains and provides proof of purchase, warranty registration, and complete service and replacement records when lodging a claim.

Failure to comply with these conditions voids the Pump/Control Unit Extended Warranty and limits coverage under this voluntary warranty to the Standard Warranty Period. This does not affect rights under the ACL.


5. SCOPE OF WARRANTY COVERAGE

5.1 Enable Lifecare warrants that the Product will be free from defects in materials and workmanship during the applicable warranty period for each component.

5.2 Where a valid claim is made, Enable Lifecare will provide a remedy consistent with the ACL and this warranty.
a) Where the failure is not a major failure under the ACL, Enable Lifecare may choose to repair or replace the Product.
b) Where the failure is a major failure under the ACL, the consumer may choose a replacement or refund in accordance with the ACL.

5.3 Remedies will be supplied within a reasonable time, consistent with obligations under the ACL.


6. EXCLUSIONS (PUMP and MATTRESS)

This warranty does not apply to:

a) Normal wear and tear, including but not limited to upholstery, fabrics, finishes, and cosmetic deterioration.

b) Mattress cover and foam degradation:

  • The outer cover, foam components, and comfort layers are subject to natural wear, compression, staining, and material breakdown over time due to use, washing, environmental exposure, and ageing.
  • Such degradation is normal and is not covered as a warranty item.
  • This exclusion does not apply where deterioration results from a defect in materials or workmanship, or where the Product fails to meet consumer guarantees under the ACL (including acceptable quality and durability).

c) Consumables and service-life components, including but not limited to batteries, compressors, solenoids, seals, gaskets, or similar parts.

d) Damage or failure caused by misuse, neglect, accident, improper storage, improper cleaning, or unauthorised modification.

e) Failures arising from the use of non-genuine parts, accessories, or servicing carried out by unauthorised providers.

f) Damage resulting from the purchaser’s failure to comply with the Product manual, servicing schedule, inflation/weight rating limits, or maintenance guidelines.

g) Damage caused by external factors, including but not limited to power surges, liquid ingress, pest damage, exposure to harsh chemicals, or abnormal environmental conditions.


7. MATTRESS-SPECIFIC CLARIFICATIONS

7.1 The Mattress warranty covers defects in materials and workmanship related to structural and functional performance (for example, air cell faults, welding seam failures, valve faults, or air retention defects not caused by puncture or misuse).

7.2 The Mattress warranty does not cover:

  • Punctures, cuts, tears, or damage caused by sharp objects;
  • Staining, odours, mould or mildew due to improper cleaning/drying;
  • Loss of comfort or support due to normal foam compression or cover ageing;
  • Damage caused by incorrect laundering, heat exposure, or use of harsh cleaning agents.

8. LIMITATIONS OF LIABILITY

8.1 To the maximum extent permitted by law, Enable Lifecare’s liability under this voluntary warranty is limited to the remedies expressly set out in Clause 5.

8.2 Enable Lifecare is not liable for indirect, incidental, or consequential loss or damage, except where such liability cannot be excluded under the ACL.

8.3 Nothing in these terms limits or excludes any liability that cannot be limited or excluded under law, including rights and remedies under the ACL.


9. CLAIMS PROCEDURE

9.1 All claims must be made in writing to Enable Lifecare or an authorised distributor using the contact details in Clause 0.

9.2 Claims must include:

  • Proof of purchase;
  • Warranty registration details (where applicable);
  • Full servicing and component replacement records (required for Pump/Control Unit extended warranty claims).

9.3 Enable Lifecare reserves the right to inspect the Product and verify compliance with Clause 4 before determining claim validity.

9.4 Where inspection is required, Enable Lifecare will advise the process and any return requirements.


9A. COSTS OF CLAIMING (MANDATORY DISCLOSURE)

9A.1 If a claim is accepted under this warranty, Enable Lifecare will bear the reasonable costs of inspection, labour, parts, and return freight (or collection/redelivery where applicable).

9A.2 If a claim is not accepted, Enable Lifecare will advise the purchaser prior to any chargeable inspection, freight, or repair costs being incurred, and the purchaser may choose whether to proceed.

9A.3 If the purchaser incurs costs in making an accepted claim (for example, freight authorised by Enable Lifecare), the purchaser may claim reimbursement by providing receipts and proof of payment.


10. PRECEDENCE OF TERMS

10.1 In the event of any inconsistency between these Warranty Terms and any marketing or promotional materials, these Warranty Terms prevail.


11. NON-TRANSFERABILITY

11.1 This Warranty is provided solely to the original purchaser of the Product and is not transferable to any subsequent owner.
11.2 Any transfer of the Product to a new owner, whether by sale, gift, lease, or otherwise, does not transfer the benefit of this Warranty.
11.3 Enable Lifecare will not recognise or accept claims under this voluntary warranty made by persons other than the original purchaser named on the proof of purchase.
11.4 For clarity, this clause applies to this voluntary warranty only and does not limit any rights or remedies that may exist under the ACL.


12. MANDATORY ACL WARRANTY STATEMENT (REGULATIONS REQUIREMENT)

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
